1. Acceptance of Terms

By accessing or using KidColoro's website (kidcoloro.com) or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These Terms constitute a legal agreement between KidColoro (operated by PRESSWAY Bartłomiej Paluch, Zarzecze 268, 38-220 Dębowiec, Poland (NIP: PL6852340178)) and you, the user. If you are under 18 years of age, your parent or legal guardian must accept these Terms on your behalf. By allowing your child to use our Service, you accept these terms on their behalf and assume responsibility for their use.

2. Description of Service

KidColoro is a free online platform and mobile application designed primarily for children aged 3-12, though it may also be used by older children and adults. All content and data practices are designed to be child-safe regardless of the user's age. The Service provides:

• Printable coloring pages for children of all ages
• AI-powered coloring page generation (user describes what they want, AI creates a coloring page)
• Online coloring tool (color directly in the browser or app)
• Blog articles with tips and guides for parents and educators
• Favorites, ratings, and download features
• Optional premium subscription with additional features

3. User Accounts

Our Service does not require user registration or accounts. Users are identified by an anonymous device identifier (UUID) that is automatically generated on first use. This identifier:

• Cannot be used to identify you or your child personally
• Is used solely to manage your favorites, ratings, AI credits, and subscription
• Can be deleted at any time through the app's "Delete Account" feature

4. Subscriptions and In-App Purchases

4.1 Free Tier

The core Service (browsing, downloading, printing coloring pages) is and will remain free. Free users receive 3 AI generation credits per day, with up to 3 additional credits available by watching rewarded advertisements.

4.2 Premium Subscription

• Premium subscriptions are available as weekly, monthly, or yearly plans
• Subscriptions automatically renew at the end of each period unless cancelled at least 24 hours before the renewal date
• Payment is charged to your Apple ID or Google Play account
• You can manage or cancel your subscription at any time through your device's App Store or Google Play settings
• Prices are displayed in local currency in the App Store / Google Play before purchase
• No refunds are provided for partial subscription periods - contact Apple/Google for refund requests

4.3 Premium Benefits

• 50 AI generation credits per day (instead of 3)
• PDF download format
• No advertisements
• Priority support

5. AI Content Generation

5.1 Usage Rules

When using the AI coloring page generation feature, you agree not to generate content that is:

• Violent, graphic, or depicting weapons
• Sexual, explicit, or inappropriate for children
• Related to drugs, alcohol, or illegal substances
• Hateful, discriminatory, or promoting hate speech
• Attempting to manipulate the AI system (prompt injection)

Prompts are automatically moderated. Violation of these rules may result in temporary or permanent restriction of AI generation access.

5.2 Generated Content Ownership

• Free users: AI-generated coloring pages are automatically submitted for moderation and may be published anonymously on KidColoro.com as public coloring pages. By using the free AI generation feature, you grant KidColoro a non-exclusive, perpetual, worldwide license to use, modify, and publish the generated images.
• Premium users: Generated coloring pages are private by default. You may optionally choose to submit them for publication. Premium users retain the right to use their generated images for personal, non-commercial purposes.

6. License and Usage Restrictions

6.1 What You May Do

• Download and print coloring pages for personal, non-commercial use at home
• Use coloring pages in educational settings (schools, daycare, therapy)
• Share printed coloring pages with family and friends

6.2 What You May NOT Do

• Sell, redistribute, or commercially exploit coloring pages from KidColoro
• Claim ownership of KidColoro's coloring pages or present them as your own work
• Use automated tools (bots, scrapers) to mass-download content
• Attempt to reverse-engineer, hack, or exploit our Service or API
• Circumvent content moderation, rate limiting, or subscription restrictions

7. Intellectual Property

All coloring pages, illustrations, blog content, code, and other materials on KidColoro are the property of KidColoro or its content creators. All rights are reserved unless explicitly stated otherwise (see Section 6.1 for permitted uses).

User-generated AI coloring pages that are published on KidColoro.com become part of our public collection but the original AI-generated image may still be used by the generating user for personal purposes.

8. Advertisements

The free version of our Service displays advertisements. These advertisements are:

• Age-appropriate and child-safe (Google AdMob with child-directed treatment enabled)
• Contextual, not behavioral (we do not track users for ad targeting)
• Not displayed during the coloring experience

Premium subscribers do not see advertisements.

9. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind
• We do not guarantee that AI-generated content will always be appropriate, accurate, or meet your expectations
• We are not responsible for any content generated by third-party AI models (Google Imagen, OpenAI)
• We make reasonable efforts to ensure content safety but cannot guarantee that all automated moderation will be 100% effective
• Availability of the Service may be interrupted for maintenance, updates, or reasons beyond our control

10. Limitation of Liability

To the maximum extent permitted by applicable law, KidColoro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers or personal information
• Any AI-generated content created through our Service
• Any interruption or cessation of the Service

11. Children's Use

Our Service is designed primarily for children aged 3-12, used under parental or guardian supervision. Parents and guardians are responsible for monitoring their children's use of the Service. We implement parental gates for purchases and external links to provide an additional layer of protection.

Minors may not use the Service without parental or guardian consent. By allowing a child to use the Service, the parent or guardian accepts full responsibility for the child's activities within the app and agrees to these Terms on the child's behalf.

12. Termination

We reserve the right to restrict or terminate access to our Service for users who violate these Terms of Service, particularly those who:

• Generate inappropriate or harmful content
• Attempt to exploit, hack, or abuse our Service
• Use automated tools to access our content

13. Modifications to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the updated terms.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Poland. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dębowiec, Poland.

For EU consumers: Nothing in these Terms affects your statutory rights under EU consumer protection law. You may also bring proceedings in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
